Stud Service Contract

Pick-of-litter stud service agreement between Motor City Yorkies (Stud Owner) and the Dam Owner. Read the full agreement below, fill in your information, and sign before breeding.

Stud Service Terms — Please Read & Agree

Section 1 — Litter Registration

The Stud Owner will sign AKC (or other) litter registration paperwork when the Dam Owner applies for a litter sired by the stud listed in this agreement.

Section 2 — Integrity of Sire

The Dam Owner will not allow the female to be bred by any male other than the stud listed in this contract during the relevant heat cycle.

Section 3 — Pick of Litter

The Stud Owner has the right to pick a puppy after viewing the entire litter, as payment for stud service. The Dam Owner will not hide any puppies born as a result of the mating from the Stud Owner. The Stud Owner will not be forced to make a pick sooner than 6 weeks from the date of whelping. A fine of $1,000 per live puppy will be assessed to the Dam Owner if it is found puppies were hidden from the Stud Owner; this fine must be paid within 30 days of written notice, or the Stud Owner may pursue legal action to collect it. The Stud Owner bears the cost of picking up the chosen puppy.

Section 4 — Waiver of Liability

The Dam Owner releases the Stud Owner and its representatives from any and all liability associated with the breeding of the dam. The Dam Owner and anyone accompanying the dam waive any liability for injury to their person while on the property.

Section 5 — One Puppy Situation

If only one puppy is born (or remains alive at 8 weeks), the Stud Owner retains the right to half the value of that puppy. The Stud Owner will not unilaterally set the sale price but will assist with the sale, if asked, and forward half the proceeds to the Dam Owner.

Section 6 — Stud Fee Payment

The stud fee must be paid in full before any attempt at a tie or mating is made. If the stud fails to tie the female and manual insemination is not used, the Stud Owner will return the full stud fee immediately, before the Dam Owner leaves the premises.

Section 7 — Liability Waiver

The Dam Owner releases the Stud Owner and its representatives from any and all liability for accident or injury to any person visiting the property, and to the dam herself, including after leaving the premises.

Section 8 — Burden of Evidence

The Stud Owner may request veterinary evidence that the dam failed to become pregnant from a prior breeding; the Stud Owner bears the cost of any such veterinary tests. The Dam Owner bears the cost of transporting the dam to the veterinary clinic chosen by the Stud Owner.

Section 9 — Health of the Dam

The Dam Owner guarantees the dam is healthy and free of disease, including Brucellosis (Brucella canis), and has not previously been bred to a male that could carry it. The Dam Owner understands the seriousness of this zoonotic disease to breeding programs and to people.

Section 10 — Agreement To Terms

By signing below, the Dam Owner agrees to all terms in Sections 1–10 of this agreement, understands no other agreements are implied, and confirms this form has been completed truthfully and to the best of their knowledge.
