Guardian Home Contract

Our guardian home program lets a loving family raise one of our program dogs as their own, while Motor City Yorkies retains ownership and breeding rights. Read the full agreement below, fill in your information, and sign to enter the program.

Guardian Home Terms — Please Read & Agree

Section 1 — Ownership and Custody

Motor City Yorkies (the "Breeder") retains full ownership, registration, and breeding rights of the dog and all breeding decisions concerning the dog. The Guardian is entrusted with the dog's day-to-day care, custody, and control.

Section 2 — Responsibilities of the Guardian

The Guardian agrees to provide a safe, loving, and healthy home environment; ensure regular exercise, proper nutrition, and socialization; take the dog to all scheduled veterinary appointments and follow prescribed treatments; keep the dog groomed and well-maintained; notify the Breeder of any health issues or concerns immediately; and make the dog available to be bred, remaining with the Breeder from heat until the resulting puppies are weaned.

Section 3 — Breeding Rights

The Breeder has the right to breed the dog for a minimum of four litters, starting on the second heat. The Guardian agrees to make the dog available for breeding and any necessary related veterinary appointments, and will notify the Breeder immediately at the first sign of heat.

Section 4 — Veterinary Care and Expenses

Routine veterinary care — vaccinations, flea/tick prevention, and annual check-ups — is the responsibility of the Guardian. Breeding-related veterinary costs are covered by the Breeder.

Section 5 — Travel and Availability

The Guardian agrees to make the dog available for breeding purposes, including travel to the Breeder's location or a designated veterinary clinic. The Breeder will provide notice of any required travel at least 5 calendar days in advance.

Section 6 — Compensation

The Guardian will be paid a minimum of 30% of the profit from each litter — total puppy sales minus fees such as puppy kits and refunds issued to buyers for initial problems after delivery (worms, transport costs, C-sections, and similar). Payments are made within 30 days of each puppy's sale. If a puppy from the Guardian's litter dies within one year and the buyer is refunded or given a replacement, the Breeder may recoup that loss as an expense against the Guardian's next litter.

Section 7 — Duration of Agreement

This Agreement remains in effect until the dog has completed its breeding career (typically four litters), as determined by the Breeder.

Section 8 — Termination of Agreement

The Breeder may terminate this Agreement and reassert custody of the dog if the Guardian fails to comply with these terms — including inadequate care, safety, communication, or failure to promptly notify the Breeder of heat cycles. The Guardian may terminate this Agreement by providing acceptable notice (text and/or call) to the Breeder.

Section 9 — Return of the Dog

Upon termination, the Guardian agrees to return the dog to the Breeder in good health and condition within 7 calendar days of notification. All papers, medical records, and related documents must be returned to the Breeder at that time.

Section 10 — Breeding Soundness

The only veterinary opinion accepted for a determination of breeding soundness is that of the veterinarian chosen by the Breeder. The Guardian will make the dog available for evaluation at the Breeder's chosen veterinarian if the dog's breeding capability is called into question. The Breeder retains ultimate authority over all breeding decisions.

Section 11 — Whelping

The Breeder has the choice and flexibility to have litters born in the Breeder's home. The Guardian may offer to have a litter born at their home but will not receive additional compensation for whelping or caring for it. The Breeder may request the dog be brought to the Breeder's home one to two weeks prior to the expected whelp date and returned to the Guardian after the puppies are weaned, typically around 6 weeks. Travel arrangements for returning the dog to the Guardian are the Guardian's responsibility.

Section 12 — Miscellaneous

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements. Amendments must be in writing and signed by both parties. This Agreement is governed by the laws of the State of Michigan.
